Terms of Service

These Terms of Service apply to purchases of products and services from Peak Simulators and to your use of our website.

By placing an order, accepting a quote, or purchasing products or services from Peak Simulators, you agree to these Terms of Service and any policies or transaction-specific terms that apply to your purchase.

Nothing in these Terms of Service limits any rights or remedies that cannot lawfully be excluded or waived under applicable law.

1. Orders, Pricing and Availability

Peak Simulators makes reasonable efforts to ensure that product descriptions, specifications, pricing and availability are accurate. However, manufacturers and suppliers may change product specifications, packaging, included accessories, software, firmware or availability without notice.

Product availability may rely on information provided by manufacturers, distributors, suppliers or fulfillment partners. An item shown as available or in stock is not guaranteed to remain available until the order is processed for fulfillment.

Peak Simulators may refuse or cancel an order where reasonably necessary due to product unavailability, an obvious pricing or listing error, payment failure, suspected fraud, shipping or regulatory restrictions, or an inability to reasonably fulfill the order.

If Peak Simulators cancels an order after payment has been collected, the amount paid for the cancelled portion will be refunded.

Unless otherwise stated, prices on our Canadian storefront are shown in Canadian dollars. Applicable taxes, shipping charges and other applicable costs will be disclosed during the transaction as required by law.

2. Third-Party Fulfillment and Delivery

Products may be shipped by Peak Simulators or fulfilled directly by third-party manufacturers, distributors, suppliers or fulfillment partners.

Unless otherwise stated, your purchase remains a transaction with Peak Simulators.

Orders containing multiple products may be fulfilled from different locations and may arrive in separate shipments.

Delivery dates and transit times are estimates unless expressly guaranteed in writing.

Peak Simulators is not responsible for delays caused by carriers, manufacturers, distributors, customs processing, severe weather, labour disruptions, shortages or other circumstances outside our reasonable control.

Nothing in this section limits any cancellation, refund or other right available under applicable law.

Customers are responsible for providing complete and accurate delivery information.

3. Product Compatibility and Use

Customers are responsible for confirming that products are suitable for their intended application unless Peak Simulators has specifically confirmed compatibility in writing.

Compatibility may depend on other hardware, mounting systems, computers, operating systems, software, games, drivers, firmware and third-party products.

Peak Simulators is not responsible for incompatibility caused after purchase by third-party software or firmware updates, operating-system changes, discontinued support, manufacturer changes, or modifications made by the customer or another third party.

Products must be installed, operated and maintained in accordance with applicable manufacturer instructions.

To the extent permitted by applicable law, Peak Simulators is not responsible for damage or failure resulting from misuse, improper installation, incorrect electrical connection, unauthorized repair or modification, accidents, physical damage, or use outside manufacturer specifications.

Nothing in this section limits any rights or remedies available where a product is defective, materially misrepresented, or otherwise subject to protection under applicable law.

4. Custom and Turnkey Simulator Systems

Peak Simulators may design, source, assemble, configure, deliver, install or commission custom and turnkey simulator systems.

Project-specific specifications, pricing, payment terms, schedules and other conditions may be set out in a quote, proposal, invoice, scope of work or other written agreement.

Where project-specific written terms conflict with these Terms of Service, the project-specific terms will govern that project to the extent of the conflict.

Changes requested by the customer after a project has been accepted may affect pricing, availability, compatibility, delivery schedules or installation requirements.

Where installation is provided, the customer is responsible for providing reasonable access to a suitable installation location and for meeting any site requirements communicated by Peak Simulators.

Additional work or return visits required because a site is inaccessible, unsafe, incomplete or materially different from the information provided to Peak Simulators may result in additional charges agreed with the customer.

5. Returns, Refunds and Cancellations

Returns, refunds, exchanges and cancellations are governed by the Peak Simulators Return and Refund Policy and applicable law.

Custom-configured systems, special-order products and products specifically procured for a customer may be subject to additional cancellation or return restrictions where permitted by law and disclosed before purchase.

Nothing in these Terms of Service or our Return and Refund Policy limits any cancellation, refund, warranty or other consumer right that cannot legally be excluded or waived.

6. Warranties

Products sold by Peak Simulators may be covered by warranties provided by their respective manufacturers.

Warranty duration, coverage, exclusions, repair or replacement procedures, parts availability and processing times are governed by the applicable manufacturer's warranty terms.

Peak Simulators may assist customers with manufacturer warranty claims where reasonably possible. Decisions regarding warranty approval, diagnosis, repair, replacement, parts availability and processing remain subject to the applicable manufacturer's warranty process.

Unless Peak Simulators expressly provides a separate written warranty, Peak Simulators does not provide an additional manufacturer-style warranty.

Nothing in this section limits any warranty, remedy or other right available under applicable law.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Peak Simulators will not be liable for any indirect, incidental, special, exemplary, punitive or consequential loss arising from a product, service, order, delay or third-party service.

Where permitted by law, this includes loss of profits, revenue, business opportunities, events, racing participation, data, use, or commercial downtime.

To the fullest extent permitted by applicable law, Peak Simulators' aggregate liability arising from a particular product or service will not exceed the amount actually paid to Peak Simulators for the product or service giving rise to the claim.

These limitations do not apply to any liability, warranty, remedy or consumer right that cannot legally be excluded or limited.

8. Events Outside Our Control

Peak Simulators will not be responsible for a failure or delay in performing an obligation where that failure or delay results from circumstances outside our reasonable control.

These circumstances may include natural disasters, severe weather, transportation or carrier disruptions, labour disruptions, government action, customs delays, cyber incidents affecting third parties, manufacturer or supplier interruptions, shortages, or similar events beyond our reasonable control.

Nothing in this section removes any cancellation, refund or other right required by applicable law.

9. Governing Law

These Terms of Service are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Subject to any mandatory consumer protection or jurisdictional rights that apply, disputes relating to these Terms of Service or transactions with Peak Simulators will be subject to the jurisdiction of the courts of Alberta.
